E&C may also make improvements and/or changes to the Site at any time without notice.

TYPOGRAPHICAL ERRORS

In the event that E&C product is mistakenly listed at an incorrect price, E&C reserves the right to refuse or cancel any orders placed for a product listed at the incorrect price whether or not the order has been confirmed and paid. If payment has already been made, E&C shall issue a credit to the original form of payment in the amount of the incorrect price.

Unless otherwise noted, product names, designs, logos, titles, text, images, audio, and video, within this Site, are the trademarks, service marks, trade names, copyrights, or other property of Apexmall, (intellectual property of Apexmall) under the United States and other copyright laws.

Permission is granted to electronically copy and print hard copy portions of this site for the sole purpose of placing an order with Apexmall

All other unregistered and registered trademarks are the property of their respective owners. No terms and conditions other than these Terms and Conditions shall be binding upon Electro & Company unless accepted by Electro & Company in writing. For all purposes, “Seller” refers to Apexmall, (hereafter noted as E&C), “Buyer” or “Customer” refers to the purchaser, both are each a “Party” and collectively the “Parties”, and “Site” refers to our website.

PROCESSING & LEAD TIMES

Standard processing time on products that do not have posted lead times is 72 business hours. Lead Times are posted on each of the individuals product pages and will be shipped within that time frame. After shipment, it typically takes 3-7 business day to arrive depending on your location within the US. International orders may take longer due to customs clearance.

COMMUNICATION

We are currently not accepting incoming calls at this time. Where we love our Moto Family, unfortunately due to our online popularity and personas we get calls from not only valued customers, but fans and with our limited staff it becomes nearly impossible to be able to help those who really need it.

For this reason, please email us at [email protected] and we will get back to you within the listed times on the automated response. If a call is determined to be needed we will get you on the schedule with a representative that can assist you with your specific need. Please see SERVICE below for further information about service related requests.

Electro & Company sends several automated responses at different stages of the process with your order.  These range from Confirmation of your order, Delays with your order, to Shipping details once your order is ready to leave the facility. Make sure to check you spam/junk folder before reaching out if you are curious about your order and feel you haven't received anything.

QUOTATIONS

Upon request, E&C will deliver a quotation to the Buyer specifying products and services to be sold and the order details for such offerings. Quotations are valid for thirty (30) days unless otherwise indicated or extended by Electro & Company. Seller reserves the right to withdraw any quotation prior to its expiration. Buyer agrees to Seller’s Quote by confirming in writing, once approved an invoice will be generated.

Payment of goods is Due Upon Receipt of Invoice unless otherwise discussed. Advanced partial payments are refundable only if goods can not be delivered by the Seller. Deposits are non-refundable unless otherwise notated in writing.

MISMATCH SHIPPING & BILLING ADDRESSES - FRAUD PREVENTION

In the event that you make a purchase where the shipping and billing addresses do not match we will require proof of address for verification before we can ship your order. This can be a photo ID with your billing address, bank statement with charge listed, etc. Our team will reach out via email, text and call to attempt verification. If you do not respond within 72 hours your order will be cancelled and refunded.

PRICING & TAXES

E&C prices and discounts are subject to change without notice and do not include any state or local taxes. Prices are quoted and payable in US Dollars only. All orders are subject to applicable shipping, freight, taxes, and handling charges. E&C collects sales tax for deliveries to all states in which we are legally obliged. Buyer shall pay all applicable taxes and excises unless Buyer furnishes E&C with a valid Reseller Certificate or tax exemption certificates prior to order.

For International Customers, Taxes, Duties or Other Fees are NOT included and will be due upon import to your country. You may use the estimated value of this order online to calculate your import taxes and fees for your specific country.

SALES

E&C will honor new sale prices at the customers request on items that have not yet shipped from E&C warehouses. Sale pricing will NOT be retroactively applied to orders that are already delivered. There is NO exceptions.

CHANGES & CANCELLATION

The Buyer may cancel online orders for stock products up until the order has been sent to fulfillment. Once fulfillment has started, the Buyer may contact customer service to inquire if cancellation is available. Changes or cancellations to custom orders can only be authorized in writing by Buyer’s and Seller’s authorized representatives and must be confirmed by a revised purchase order from the Buyer. If any change requested by the Buyer causes an increase or decrease to the cost, delivery schedule, or other terms, the Seller shall notify Buyer of the change in cost, delivery, or other terms. An adjustment to cost, delivery schedule, or other terms shall be mutually agreed upon in writing by the Parties. The Seller reserves the right to cancel any order at any time for any reason seen as appropriate. If an order is requested to be refunded after payment has been received by Seller a 5% Non-Refundable Reservation Fee will be assessed prior to refund to cover costs associated with your cancellation.

WARRANTY

BIKES

Bikes sold by E&C have a 30-day limited warranty against defects, a 6-month limited warranty on powertrain parts and for the first year a 30% discount on powertrain parts.

Items covered under powertrain limited warranty: Motor, Controller, Display & Battery.

Excluded Wear and Tear Items: Tires, Tubes, Brake Pads, Brake Rotors, Chains, Sprockets.

Water, accident or crash damages are NOT covered under warranty.

Any damage resulting from the use of non E&C parts is NOT covered under warranty.

Abuse or Misuse of the product voids warranty.

The failure mode will be determined by E&C staff who are experts in the field of powersports product development, operation and service. Warranty is non-transferable.

PARTS & KITS

E&C has a 30-day limited warranty against defects on all products and 6-month limited warranty against defects on Powertrain components.

Items covered under powertrain limited warranty: Motors, Controllers & E&C Batteries.

Excluded Wear and Tear Items: Tires, Tubes, Brake Pads, Brake Rotors, Chains, Sprockets.

Water, accident or crash damages are NOT covered under warranty.

Any damage resulting from the use of non E&C parts is NOT covered under warranty.

Misuse, miss installation, overheating & abuse are not covered under warranty. The failure mode will be determined by E&C staff who are experts in the field of powersports product development, operation and service. Warranty is non-transferable.

EON LITHIUM BATTERIES

Eon Lithium Provides a 1 year manufacturer limited warranty. Please see there full warranty on their site here: EON TOS

Water, accident or crash damages are NOT covered under warranty.

Any damage resulting from the use of non E&C parts is NOT covered under warranty.

Misuse, miss installation & abuse are not covered under warranty. The failure mode will be determined by Eon Lithium staff who are experts in the field of battery manufacturing, design and service. Warranty is non-transferable.

WARRANTY SHIPPING INFO

For customers in the lower 48 states E&C pays warranty shipping both ways for 30 days. After 30 days customers will be responsible for return shipping.

For customers outside of the lower 48 states, customers will be responsible for shipping both ways. No exceptions will be made.

RETURNS

Due to the DIY or Custom nature of the products sold by E&C, returns are not accepted. Instead we provide support and or repair services to help keep our customers up and running. 

SERVICE

If you are experiencing Service issues and need assistance, email us at [email protected]. You must include your Name, Email or Order number as it is listed on your original purchase. Please do not send us the receipt number, this is for your records only and does not tie to anything within our system. Give us a detailed description of the issue you are having, for example; When did this first occur? Did you experiences an event before the issued occurred such as fall or or during charging? Is the controller experiencing any beep codes? Have you modified the product in anyway? 

In addition to the required above information, please ensure you send us several photos of the powertrain, specifically the top of the controller along with the connections, along with any and all damaged components (if any). If experiencing a battery related issue, ensure you have downloaded the ANT BMS app and send screenshots of the details on the dashboard. These will enable the team to visually inspect the product to determine next steps. In many cases our trained team can easily see something in the photos that will allow them to assist you virtually and save on down time. If they are not able to we will give you our shipping address and have you return it for us to investigate further. Please see the above WARRANTY section for clarification on warranty issues, if covered under warranty our team will send you a return label.

SHIPPING

Electro & Company is not responsible for lost, misplaced, or delayed shipments or damaged freight by the freight carriers after they have been dispatched. Electro & Company cannot be held responsible / liable for lost or stolen packages that have delivery confirmation to the address that was provided. The customer accepts full responsibility to file any claim(s) with carrier for damaged and/or lost shipments. We are not responsible for mis-delivery errors via carrier, or incorrect shipping info. 

Packages rejected by the Customer will forfeit their shipping cost and will incur new costs for shipping if item needs to be resent. If you receive a package that is damaged by the shipping carrier, do not reject or return the items. Simply notify us via email and our team will get you the proper replacement parts sent out as soon as possible.

BATTERIES

Electro & Company, Inc. does not manufacture batteries. All batteries sold on www.apexmall.shop are currently manufactured by Eon Lithium or Quasar Lithium and is not responsible for damages or liability from battery-related issues. Batteries can be dangerous in nature. If an issue arises please let us know and we will put you in contact with the Manufacturer of your particular battery to get any issues resolved.

PERSONAL SAFETY

Motorcycles are inherently dangerous in nature. Due to the DIY nature of the kits sold by Electro & Company, Inc., you are fully responsible for your own safety. Always check your vehicle over before riding/driving and test accordingly to ensure it is working in a safe manner. The electronics in our kits are NOT Shockproof or Waterproof which can cause electrical failures that can result in personal harm or property damage. Electro & Company, Inc. is not liable or Responsible for any damage or injury that occurs while using our equipment.
